What Judge Kavanaugh’s Confirmation to the Supreme Court Means for Chris

Ever since the time of the Roman Empire, the principle that a person should be considered innocent until proven guilty has governed criminal justice systems in the civilized world. This idea is commonly stated in Latin “ei incumbit qui dicit, non qui negat” (“the burden of proof is on the one who declares, not on the one who denies”). When Dr. Ford came forward with her accusation of attempted rape against Judge Kavanaugh, thinking people asked only that Dr. Ford would provide some evidence or some corroborating witness to testify to the guilt of Judge Kavanaugh. When no evidence and no corroborating witnesses could be produced, the question became, would we, as a people, hold fast to this principle that the burden of proof lies on the accuser, and that the accused person should be considered innocent until proven guilty? Or would we, as a people, abandon this principle and destroy a person under the mere accusation of a crime? It appears as of this writing that the former has prevailed, and Judge Kavanaugh has been appointed to the Supreme Court.

What does this mean for Chris? It gives Chris and his family and friends hope that justice may yet be done in his case. It has been nearly one full year since Chris’ baby girl died and the police forces charged Chris with rape and murder. And yet there has not been one shred of evidence produced to show that Chris committed this crime. Still no trial date. Still no hope to post bail. And so the question comes up again in this dark age. Will the police forces continue to lay the burden of proof at Chris’ door? or Will they be held accountable to lay the burden of proof at their own doorstep and set free this innocent man? Thinking people must stand up to insist that the principle of ei incumbit qui dicit, non qui negat continue to govern our criminal justice system. Chris’ family and friends urge everyone to contact their elected representatives and tell them that we demand a police force that will not abandon this sacred principle.

    I exactly agree! I am contacting people in trying to get some action with these ridiculous charges against Chris.
